How Much Child Support Will I Pay or Receive?
In California, child support is calculated by a complex formula set out in the California child support guidelines. Although California law permits a judge to deviate from the guidelines in cases involving extraordinary circumstances, deviations from the guidelines are rare. However, a change in financial circumstances can lead to a change in child support payments.
Child support is calculated by a consideration of each parent's income, parenting time and available tax deductions. The guidelines are set out in California Family Code Sections 4050-4076. Section 4057 of the California Family Code states circumstances that may warrant a deviation from guideline child support.
What if I Lose my Job or get a Pay Cut?
Someone who is obligated to pay child support can seek a modification of child support if they have lost their job or received a pay cut (depending on the amount of the pay cut). However, a child support obligor may not decrease their child support obligation by voluntarily quitting their job or accepting a temporary pay cut if their purpose is solely to decrease their child support obligation
